On June 18, 2024, the Department of Homeland Security (DHS) announced a key step toward fulfilling President Biden’s and Vice President Harris’s commitment to promoting family unity in the immigration system. Obtaining a green card can be achieved through various paths, including sponsorship by a U.S. citizen or permanent resident family member. This new process will allow eligible noncitizens to apply for lawful permanent residence without having to leave the United States.
Family PIP for The Biden-Harris Initiative
This new processing allows certain family members to have their green card applications processed quicker than the normal processing time. The United States Citizenship and Immigration Services (USCIS) considers all green card requests on a case-by-case basis and has sole discretion on whether to approve or deny the request.
Since this type of processing essentially puts you ahead of other green card applicants, USCIS carefully weighs the urgency and merit of each request before coming to a decision. In some cases, they may also require supporting documents to establish your eligibility.
To be eligible for The Parole In Place for Your US Family members, you must meet the minimum following requirements:
- Be present in the United States without admission or parole.
- Have been continuously present in the United States for at least 10 years as of June 17, 2024; AND
- Have a legally valid marriage to a U.S. citizen as of June 17, 2024
- must not have disqualifying criminal history or otherwise constitute a threat to national security or public safety
- should otherwise merit a favorable exercise of discretion
Noncitizen children of spouses who are granted parole under this process may also be considered for parole on a case-by-case basis under this process if they are physically present in the United States without admission or parole and have a qualifying stepchild relationship with a U.S. citizen parent as defined by the Immigration and Nationality Act as of June 17, 2024.
