  • You’re the beneficiary of a qualified immigrant petition or application for labor certification that was filed on or before April 30, 2001
  • If you’re the principal beneficiary and the petition was filed between January 15, 1998, and April 30, 2001, you must have been physically present in the United States on December 21, 2000
  • You’re currently the beneficiary of a qualifying immigrant petition or an application for labor certification. This can be either the original Form I-130 or I-140 through which you’re grandfathered, or a subsequently filed immigrant petition.
  • You’ve filed Form I-485, Application to Register Permanent Residence or Adjust Status and Form I-485 Supplement A
  • You’ve paid the $1,000 fee (unless you’re exempt)
  • You were physically present in the U.S. at the time you filed Form I-485 and Supplement A
  • You have a visa immediately available to you
  • You’re admissible to the U.S. or eligible for a waiver of inadmissibility or other form of relief
