Understanding the 245i Green Card Program

The 245i program was created to provide relief to certain individuals who may not be eligible for a green card through traditional means. It allows applicants to adjust their status and obtain a green card regardless of whether they entered the U.S. illegally, worked in the U.S. without authorization, or failed to continuously maintain lawful status since entering the U.S.

Obtaining a 245i green card offers numerous benefits and advantages. One significant advantage is that it allows applicants to adjust their status within the United States without having to leave the country and risk being subject to a lengthy bar from reentering. Another advantage of the 245i program is that it allows individuals to overcome certain grounds of inadmissibility that would otherwise prevent them from obtaining a green card. This opens up opportunities for individuals who may have previously been ineligible due to immigration violations or other legal barriers. Contact the Ranchod Law Group today to get started on your 245i application.

245i Eligibility Requirements

Under the section 245(i) provision, you may be eligible to obtain a green card if you meet the following criteria:

  • You’re the beneficiary of a qualified immigrant petition or application for labor certification that was filed on or before April 30, 2001
  • If you’re the principal beneficiary and the petition was filed between January 15, 1998, and April 30, 2001, you must have been physically present in the United States on December 21, 2000
  • You’re currently the beneficiary of a qualifying immigrant petition or an application for labor certification. This can be either the original Form I-130 or I-140 through which you’re grandfathered, or a subsequently filed immigrant petition.
  • You’ve filed Form I-485, Application to Register Permanent Residence or Adjust Status and Form I-485 Supplement A
  • You’ve paid the $1,000 fee (unless you’re exempt)
  • You were physically present in the U.S. at the time you filed Form I-485 and Supplement A
  • You have a visa immediately available to you
  • You’re admissible to the U.S. or eligible for a waiver of inadmissibility or other form of relief

Under certain circumstances, the spouses or children of a grandfathered individual may also be eligible for benefits under section 245(i) of the Immigration and Nationality Act (INA). They may qualify as dependents or as individuals who are themselves grandfathered. Contact the Ranchod Law Group today to discuss your eligibility.

Overcome Challenges with Your 245i Green Card Application

During the 245i green card application process, there are certain challenges you may encounter. One common challenge for applicants is verifying their eligibility, which involves demonstrating physical presence in the United States on the specified date, establishing continuous residence, and validating the qualifying immigrant petition or labor certification. Meeting these requirements often requires meticulous documentation and experienced legal guidance.

Timelines and deadlines are crucial in the 245i program; failing to meet these deadlines or missing important milestones can jeopardize your application. It’s very important to stay organized and ensure that all forms and supporting documents are submitted on time to avoid complications or potential denials.

Another challenge to be aware of is the potential Request for Evidence (RFE). USCIS may issue an RFE to request additional documentation or clarification on specific aspects of the application. Responding effectively to an RFE requires a thorough understanding of the requirements, making the guidance of an experienced immigration attorney invaluable.

Inadmissibility issues can also pose significant challenges. Factors such as certain criminal convictions or immigration violations may cause you to be inadmissible under U.S. immigration laws. Overcoming these issues often requires additional waivers or legal strategies to demonstrate your eligibility for the 245i program. Lastly, changes in immigration policies can impact the 245i green card application process, so it’s crucial to stay updated with any changes or updates in immigration regulations that may affect your case.

Navigating these potential challenges can be daunting, but with the guidance of the Ranchod Law Group, they can be addressed effectively. Contact us today for a consultation.
