What is Parole in Place?

In recognition of their contribution and sacrifices to our country, military service members are eligible for special immigration benefits, including Parole in Place (PIP).

Normally, if your spouse or parent entered the United States unlawfully, you would have to go through a lengthy waiver process of about 4-5 years to overcome unlawful presence; during this time, your family member would be required to return to their home country until the waiver was approved. PIP overcomes unlawful entry in and allows military families to stay together in the U.S. while family members pursue legal status.

At the Ranchod Law Group, we appreciate the dedication of our service members and recognize the importance of keeping families unified throughout the adjustment of status. We’re committed to helping you navigate the Parole in Process with ease and tailor our advice and strategies to your unique circumstances. PIP Eligibility Requirements

Parole in Place (PIP) eligibility is determined on a case-by-case basis, considering urgent humanitarian reasons or significant public benefit as outlined in section 212(d)(5)(A) of the INA. Spouses, widow(er)s, parents, and children of military service members may be eligible for PIP in one-year increments, provided the service member falls into one of the following categories:

  • Active-Duty Member of the U.S. Armed Forces
  • Selected Reserve of the Ready Reserve, or
  • Individuals (living or deceased) who previously served on active duty or in the Selected Reserve of the Ready Reserve and were not dishonorably discharged

It’s important to note that Parole in Place is exclusive to military family members who entered the U.S. illegally. If the family member was allowed to enter the U.S., but overstayed their visit, they do not qualify for PIP. In those cases, you may be able to apply for deferred action or another immigration benefit.
