  • Under the federal Violence Against Women Act (VAWA), you may be eligible to become a lawful permanent resident (get a Green Card) if you are the victim of battery or extreme cruelty committed by:
  • A U.S. citizen spouse or former spouse;
  • A U.S. citizen parent;
  • A U.S. citizen son or daughter;
  • A lawful permanent resident (LPR) spouse or former spouse; or
  • An LPR parent.
  • The abuse or battery occurred during your relationship.
  • If your abuser was your spouse, you must be able to prove that the marriage was genuine.
  • You reside in the U.S. (with some exceptions).
  • You lived with your abuser at some point.
  • You can show that you’ve been a person of good moral character for at least the past three years.
  • Gather relevant documentation and evidence to support your VAWA status. This can include police reports, medical records, photographs, affidavits from witnesses, and any other evidence that proves the abuse you have suffered.
  • Prepare and submit your VAWA self-petition to USCIS, including strong evidence and a detailed personal statement describing the abuse you endured and how it relates to the VAWA requirements
  • USCIS will review your VAWA self-petition and supporting documents and then make a decision.  
  • If your VAWA self-petition is approved, you can proceed with either adjusting your status if you are already in the United States or consular processing if you’re residing abroad.
