The latest success story to come out of The Ranchod Law Group belongs to a Pakistani national for whom we filed a Waivers of the two-year home residency requirement based on exceptional hardship to his United States citizen wife. By working closely with the clients, we were able to successfully demonstrate that his wife would suffer exceptional hardship if he were to move back to Pakistanfor two years. We highlighted the fact that due to her recurrent major depressive episodes coupled with chronic pain, that being without her husband for two years was simply not an option as she would suffer medical hardships. Our argument explaining why she could not relocate was airtight as well. The husband is Pakistani and Muslim, while his United States citizen wife is a white, Christian woman. This kind of arrangement would already be socially frowned up in Pakistan, but adding to the exceptional hardship was the fact that the husband already had an arranged marriage, per local custom. Upon breaking that arranged marriage, our client effectively made himself and his family a target. Therefore, we were able to successfully argue that their lives would be in danger upon relocation to Pakistan. It is work mentioning that the case was approved without a Request for Evidence (RFE); in today’s climate, that is a huge feat!

Pakistan Citizen J1 Hardship Waiver Approved

Hi this is Kaushik Ranchod here today from The Ranchod Law Group and what we are talking about is J-1 Visa Waivers and exceptional hardship waivers.

Recently we just got an approval for someone a Client from Pakistanand I’m going to tell you how we did it.

So when you apply for a J-1 Visa Waiver the biggest mistake that I’m still seeing is people are waiting too long. Right now it is taking anywhere from eighteen and a half to two years to get a Waiver and these times are changing all the time. But specifically:

how we got this approved

Every case is unique and in this situation the Pakistani spouse was Christian and he was Muslim. So if she would have went back to Pakistan, their lives could have been endangered because of that relationship. And so that was one factor that we talked about. So in the J-1 exceptional hardship Waiver you need to demonstrate hardship if you’re separated and hardship if you or your spouse, who is the US citizen remains in the US while you go back, or if your spouse joins you, also have to show extreme hardship.

So what’s the hardship I just talked about?

It was in the event you should both return to your home country. Another way that we demonstrated the hardship was because if the US citizen were to remain in the United States she had also a history of depression and that depression would be exacerbated. So with both of those factors we were able to get a J-1 hardship waiver approval without an RFE and in today’s day and age that is very significant because USCIS is issuing a lot RFEs for J-1 Waivers. Every case is unique so just because we’ve got this case approved doesn’t mean that your case would be approved, but contact our office at (916) 613-3553 so we can evaluate your situation and see if you qualify to apply for a J-1 exceptional hardship Waiver.

These cases require a lot of work to demonstrate the exceptional hardship: you write a legal brief explaining the hardship because it’s more than just mere separation and so it requires more than just filling out the form. We believe it needs a legal argument especially in this day and age with the Trump Administration so that’s why we prepare a legal brief.

Marriage Green Card Interview Tips You need to Hear

Hi this is Kaushik Ranchod from The Ranchod Law Group and I’m here with Brian. Today we are talking about marriage green card interviews part 2. So Brian, what kind of questions have we been getting? The question is how early should someone arrive to the interview? I know in the notice it says 30 minutes before but is it accurate right now? That’s a great question! Well a lot of things are changing you know very frequently with the Trump administration, so before you know 30 minutes were fine but I would recommend an hour because it’s taking so long right now as of June 2019 to go through security, so you should be there an hour ahead of time just to make sure that you have plenty of time for security – and at that security check what will they check?

So you want to make sure you have your government ID and your interview notice. You should also bring your passport to the interview as well. So you know it’s important then, in that situation, to speak with who’s in charge because with a lot of new trainings going on, you want to think of the security as like going to
the airport through that type of security – that’s what the security is like now.

Once you get to the appointment what kind of question will they ask in the marriage based interview?

For a marriage-based green card they can ask questions such as:

  • How did you meet?
  • What was the date of your marriage?

Those are a couple of common questions that they ask.

Is there any way they can ask something that you don’t know? Something crazy?

Uh yes they can! They can ask something that you don’t know and sometimes you know you’re not gonna know every single fact about your spouse so don’t worry
about that – it’s the majority of questions as long as you know the majority of questions it should be fine but if there’s a lot of questions that you don’t know then that’s gonna raise a red flag, but you’re not going to know every single thing about your spouse so if you all of a sudden can’t remember something don’t let that derail the rest of your interview.

Finally: why is so important to have an attorney present in that interview?

well now with the current President Trump administration I highly recommend that you have an attorney go with you to the interview because they can ask questions there which are inappropriate and you want to have the attorney there to intervene in that situation and if your case for whatever reason is denied, then you also have the attorney there who is a witness to what happened just in case the officer in the decision misconstrues the facts of what occurred: you have the attorney who was there as a witness to know exactly what happened and to clarify the actual testimony that occurred

Hola, soy Kaushik Ranchod, aqui con Brian. Hoy vamos a hablar de lo que estamos aprobando ahora. Sobre las Exenciones I-601, porque como saben, con la administración del Presidente Trump se está volviendo mucho más difícil que estos casos sean aprobados. En general, la tasa de negación ha incrementado un 40%.

Nuestra firma aún está por encima del 90% de aprobaciones en términos generales. Pero los casos que se están aprobando (y claro que tengo que decirlo aun cuando nuestros casos están siendo aprobados), no quiere decir que todos nuestros casos serán aprobados en el futuro. Es por eso que es tan importante evaluar cada factor específico y único y usted puede llamarnos al 916-613-3553 si tiene preguntas.

En la Exención I-601A para la que acabamos de obtener aprobación, de lo que hablamos en esta situación es que usted debe demostrar, para una Exención por perjuicio excepcional I-601A, un perjuicio excepcional para el ciudadano de los United States si estuvieran separados o si el ciudadano de los estados Unidos tuviera que ir al país de origen del esposo. Una cosa que hemos demostrado es el historial de trauma psicológico que el ciudadano de los Estados Unidos había tenido y cómo podría continuar ocurriendo e incluso aumentar significativamente debido a la separación.

A eso se le conoce como perjuicio psicológico.

Entonces juntamos todos estos factores para demostrar el perjuicio excepcional. En muchos de nuestros casos no hay UN solo factor que en sí mismo constituya un perjuicio excepcional, pero cuando combinamos todos estos factores ¡BOOM! ¡Podemos demostrar perjucio excepcional!

Hay un factor importante que dejé fuera, que es la condición de salud del cónyuge, que también fue un factor importante en el perjuicio excepcional.

Es muy importante recordar al presentar el caso para las exenciones de prejuicio excepcional:

  • Proveer una gran cantidad de registros médicos. Esto es porue no puede simplemente inventar cosas, sino que necesita respaldarlo con evidencia.
  • Crear un informe legal muy extenso con atención a los detalles, describiendo todos los factores y vinculándolos con un argumento legal que demuestre el perjuicio excepcional y cómo a través de la totalidad de las circunstancias, todos los factores crean un perjuicio excepcional.

¡Hola, soy Kaushik Ranchod de The Ranchod Law Group! Pues hoy vamos a hablar acerca de algunos aspectos básicos de la entrevista del Servicio de Ciudadanía e Inmigración de Estados Unidos (USCIS). Primero que nada, mientras estoy hablando el día de hoy 12 de marzo. Al tener la entrevista con el Servicio de Ciudadanía e Inmigración, antes usted ponía la notificación en el buzón y ellos le llamaban. Ahora, usted pone la notificación en otra sala, y después pasará a la sala de espera principal para luego ser llamado a la entrevista.

Entonces, ese es uno de los puntos básicos para estar preparado a su llegada y que ya sepa qué está ocurriendo, para poder sentirse un poco más cómodo durante la entrevista. ¡Llámenos al (916) 613-3553 o postee su pregunta en la parte de abajo! Entonces, ¿qué otras preguntas estamos recibiendo? Acerca de tener un intérprete- La gente quiere saber si pueden traer a sus hijos o a un hermano a la entrevista como intérprete para la persona que está siendo entrevistada.

Hi this is Kaushik Ranchod from The Ranchod Law Group with offices in Sacramento and Stockton. I’m here with Brian and we are here for our weekly Immigration Show.

Alright so today, we are gonna talk about the latest and greatest immigration trends and we’re going to talk about DACA. As you know with this administration we’re talking about the “loco” things that are going on… so eighty-six percent of Americans support DACA and there’s current house legislation that has been worked on to help make DACA happen because people who came here as children deserve to be legal.

Trump is receiving a lot of pressure from Republicans and Democrats and the courts on DACA, so we have to just keep on continuing to let our Congress people know that we support DACA so that something passes. Now moving on to the latest trend, what is happening – can you believe that immigration is finally moving on to electronic applications??!!

So this isn’t in all the applications it’s just some right now, but they’ve indicated that that’s the direction that they want to go: they want to become modernized and what I have to say is it’s about time! You know with many other different agencies you can file electronically as we’re not in the dinosaur ages anymore where we need to mail in applications – it’s such a waste of resources and time. USCIS has rolled this out with a couple of applications and we’ll see where they go with it just.

A Healthy Balance – Fun and Fitness Go Together

How is this season treating you? For me, there are a lot of fun activities happening in the next few weeks that I want to share with you.
After talking about it for a while, we’re finally going skiing! I’m very excited. It’s been a while since we’ve skied, so we’re taking lessons. I think they’ll provide some much needed pointers and help us start off on the right footing — or should I say binding?

Skiing isn’t the only fitness activity we have going on this spring: My wife and I recently started taking dance lessons! We hope to eventually learn salsa, but we’re starting off with the fundamentals. It’s been a lot of fun! We’re excited to learn and get better together.
Speaking of getting better together, I’m going on my second fitness challenge at my gym, and three of my team members at Ranchod have joined the program. I feel proud to share that I’ve lost 16 pounds since starting this whole weight loss journey. Some of my team members have lost over 10 pounds, and everyone is getting healthier and fitter in the process. Committing to our health is an important value at Ranchod Law Group. Our employees even get a gym reimbursement to encourage healthy habits. It’s a team effort, after all.

Later this month, I’m hoping to visit my sister in Seattle for her birthday. It’s an exciting celebration, and I’m looking forward to some quality time with her. My hope is that we can go to Whidbey Island, which is north of Seattle in the Puget Sound. You take a ferry from Seattle to get there, and there are supposed to be beautiful views as well as some great hikes. We may even get to do some whale watching!

At home, Happy is improving quickly with the help of his kind and patient trainer. He’s been doing really well learning the skills the trainer is teaching him, like learning not to run out the door. Instead, he sits patiently and waits to get his little treat of chicken. We’re happy that Happy is settling into our home and becoming part of our family.

The last couple of months have been very busy at the office. We finished up filing the most H1B visas we’ve ever done. We’re grateful to be part of so many journeys of people starting new lives. We appreciate all of you who’ve referred friends, family, and clients to us. It is our joy and purpose to help people through the immigration process and keep families together.

We hope you have a wonderful next couple of months. Thank you for being part of what we do.

Un cliente de Visa U recibe una llamada del número 1-888

Nuestra oficina en Sacramento recibió una llamada de un cliente de U Visa que nos llamó porque recibió una llamada de un número 1-888-867-3913, y la persona con la que habló le dijo que sería arrestada en 3 horas y que necesitaba llamar al siguiente número : 1-877-487-0773. Mencionaron un nombre, Peter Jackson, y le dieron a nuestro cliente un número de caso.

Nuestro cliente es una madre que tuvo a sus tres hijos con ella. Estaba muy preocupada. Afortunadamente, ella nos llamó y llamamos al número varias veces. Pudimos determinar que era un fraude.

Tenga en cuenta este tipo de estafas. Ni ICE ni USCIS ni la policía llamarán a una persona para informarles que serán arrestados. Si no tiene documentos, pídale a alguien que tenga estatus que llame y pregunte en su nombre si no se siente seguro.

U Visa Client Receives call from 1-888 number

Our office in Sacramento at The Ranchod Law Group received a call from a U Visa client called us because she received a call from a 1-888-867-3913 number, and the person she spoke with told her she would be arrested in 3 hours and needed to call the following number: 1-877-487-0773. They mentioned a name Peter Jackson, and provided our client with a case number.

Our client is a mother who had her three children with her. She was understandably worried. Luckily, she reached out to us and we were able to call the number several times in order to determine it was fraudulent.

Please be aware of these kinds of scams. Neither ICE, USCIS, or the police will call an individual to let them know they will be arrested. If you are undocumented, please ask someone who has status to call and inquire on your behalf, if you do not feel safe.
